Brazil and France sign patent prosecution highway (PPH) agreement

The Brazilian and French PTOs signed, on March 15th, 2022, an agreement to expedite the examination of pending Brazilian applications. The agreement consists on implementing a PPH Pilot program between both Offices. The program will come into force on May 1st, 2022.

The BRPTO is currently expanding its cooperation agreements and notifying the Brazilian patent system users via its website about the new participating Offices. The following Offices participate in the current PPH program:

As informed in our client alert from January 3rd, 2022, the BRPTO’s PPH program is regulated by Ordinance #55/2021. It includes the possibility of 100 PPH requests based on the International Preliminary Report on Patentability (IPRP) and up to 800 PPH requests per year. The number of applications per applicant is one per week, and the number of applications per IPC Section is 150 applications per section per year.
